    Functions:

    Market and Competition Division 1

    • Implementing the Government’s subsidy scheme to encourage the extension of fibre-based network to villages in remote areas
    • Overseeing implementation of the Competition Ordinance (CO) in the broadcasting and telecommunications sectors and liaison with the Competition Commission which shares concurrent jurisdiction with the CA
    • Handling cases related to the CO in the broadcasting and telecommunications sectors, as well as providing advice and analysis on competition related matters
    • Administering economic consultancy engagement
    • Administering Customer Complaint Settlement Scheme
    • Monitoring overseas regulatory developments and identifying best practices for review and adoption in Hong Kong
    • Managing various regulatory measures for protection of interests of telecommunications service consumers and monitoring their effectiveness
    • Handling cases related to the Trade Descriptions Ordinance (TDO) involving broadcasting and telecommunications licensees
    • Enforcing real-name registration programme for SIM cards
    • Co-ordinating road opening works of telecom operators
    • Enforcing the protection of underground telecommunications infrastructure as proposed in the amendments to the Telecommunications Ordinance (TO)
    • Handling CA determinations under section 36A of the Telecommunications Ordinance
    • Handling CA authorisations under section 14(1A) of the Telecommunications Ordinance

    Market and Competition Division 2

    • Implementing the Government’s subsidy scheme for encouraging early deployment of 5G
    • Overseeing implementation of the fair trading sections of the TDO in the broadcasting and telecommunications sectors and liaison with the Customs and Excise Department which shares concurrent jurisdiction with the CA
    • Handling cases related to the TDO involving broadcasting and telecommunications licensees, and providing enforcement support where necessary
    • Managing the spectrum auctioning platform and conducting spectrum auctions
    • Handling matters related to universal service arrangements
    • Handling public payphone related matters, including the use of payphone kiosks for providing various public telecommunications services and smart kiosks functions
    • Providing legal support to CA and OFCA
    • Administering legal consultancy engagement
    • Handling CA determinations under section 36A of the Telecommunications Ordinance
    • Handling CA authorisations under section 14(1A) of the Telecommunications Ordinance
    • Providing secretariat support to the Telecommunications Affairs Committee (TAC)
    • Coordinating telecommunications issues for reporting to the CA via DG-Com report
    • Implementing the enhanced appeal mechanism as proposed in the TO amendments
